Tunbridge Wells
Borough Council

In the preliminary phase of contract discussions, particularly during the heads of terms stage, it’s crucial for both parties to agree on a term that provides ample time for executing the land promotion and planning strategy in accordance with the council’s Development Plan timeline.
Despite best intentions, it’s common for local authority
local plan adoption schedules to experience significant delays.

The objective of a successful land promotion campaign is to secure inclusion of your land in the council’s plan as an allocated site, enabling us to subsequently obtain planning permission in line with the adopted development management policies.

It’s important to note that planning applications submitted before the land’s inclusion in the Development Plan are typically refused, unless they are in line with current development plan policies, or the local authority is not meeting its housing targets as specified by the National Planning Policy Framework.

Given the high number of competing sites and the council’s preferred
Spatial Strategy, it’s not unusual for sites to be initially unsuccessful in the current emerging development plan review. Often, the prospects for success improve substantially in the subsequent Five Year Plan Review.

Therefore, it is in the best interest of both parties that the contract length accommodates potential delays and various scenarios.

Tunbridge Wells Borough Council is currently in the Examination stage of their Local Plan, with Stage 3 hearings scheduled for November 2024. The Plan sets out proposals for development across the borough up to 2038, including strategic allocations for housing and infrastructure. Upon adoption, anticipated in 2025, allocated sites will be eligible for planning applications, providing significant opportunities for developers and landowners to bring forward housing schemes.
